California Labor Law Firm Files Suit Against Lowe’s for Unpaid Overtime to Assistant Store Managers and Former Zone Managers – Los Angeles Wage & Hour Claims Attorneys Blumenthal, Nordrehaug & Bhowmik

flsa exempt coveredThe California labor law firm Blumenthal Nordrehaug & Bhowmik has filed a class action labor lawsuit against Lowe's HIW, Inc., (“Lowe's”).  According to the complaint, Lowe's wrongfully classified their Zone Managers and Assistant Store Managers as exempt from overtime and therefore failed to pay overtime due to these employees. Valle, et al. vs. Lowe's HIW, Inc., Case No. CV-11-1489.

“Lowe’s Zone Managers and Assistant Store Managers spent the majority of their time performing non-exempt work tasks throughout their shifts,” said Norman Blumenthal, founding partner of Blumenthal, Nordrehaug & Bhowmik.  “Under the Fair Labor Standards Act, workers who perform non-exempt work are entitled to overtime pay when they work more than 40 hours a week or 8 hours per day.”

The Complaint states that zone managers and assistant store managers just had a managerial title.  In effect, they actually spent little to no time performing managerial work.  They also worked well over 40 hours a week and sometimes as high as 65 hours per week.

Lowe's Assistant Store Managers or Zone Managers who work, or have worked in California, may have a claim for overtime wages due to a misclassification as exempt employees attorneys for Blumenthal, Nordrehaug & Bhowmik assert in the Complaint.
