The firefighters are seeking compensation they are allegedly owed, double the damages for a period of three years, interest and legal fees. The overtime lawsuit was filed in the midst of contractual negotiations between the Hermosa Beach firefighters and the Los Angeles County Fire Department, seeking their firefighting services.

Hermosa Beach Mayor Jeff Duclos responded to the lawsuit stating that he was disappointed in the action taken by the firefighters regarding their concern over wages and overtime. He also noted that the city had just been notified of the lawsuit. The mayor was concerned that while the city had been in good faith negotiations for close to a year with the union on a number of issues, this particular FLSA issue was never broached. He claims the city has always been fair with their firefighter and are very grateful for the service they provide the community. He felt that they had ample opportunity to bring the topic up without the unnecessary hassle of a lawsuit against the city.

City records indicate that 10 of the highest paid city employees of 2016 were firefighters due to overtime hours and overtime pay. Pay ranged from $156,000 to $307,761. In 2017, the highest paid city employee will also be a firefighter who will reach a total of $400,000 in compensation for the year. The Hermosa Beach fire department will be dissolved effective December 30th, 2017 and the city will hold a ceremony recognizing the changeover on December 29th, 2017 in the Community Center Theater.
