Multi-Industry Field Case Managers are Routinely Denied Overtime Pay – Los Angeles Wage & Hour Claims Attorneys Blumenthal, Nordrehaug & Bhowmik

They are field case managers, and according to a class action lawsuit filed by Blumenthal, Nordrehaug & Bhowmik against healthcare employers such as Coventry Health Care, Inc. and Holdings Inc d/b/a Genex Services, Inc. the tasks performed by Field Case Managers are not administrative.  Though, in addition to such tasks as outlined above, Coventry required its field case managers to have a state-licensed RN and three or more years of case management experience, in actuality the Field Case Managers never engaged in direct patient care like RN’s.  Therefore, any employer, such as Coventry, that classifies a Field Case Manager as administrative personnel exempt from California law and FLSA has committed an unlawful act.  The complaint also alleges that Coventry failed to provide adequate meal and rest breaks, or submit accurate wage statements.  All are required to be provided to nonexempt employees under California labor law.
