Overtime“Working stiffs who voted Democrat in the last election are not felony stupid,” said Norman Blumenthal, the managing partner of the Employment Law firm Blumenthal, Nordrehaug & Bhowmik.  “But not only do elections have consequences, state laws have consequences.

California has had one of the largest increases in employment of any state.  Why? Because California has the most labor family laws in the country, and through a private attorney general act California attorneys have been deputized to prosecute employers on behalf of the state who violate California employment laws.  Thus, most California employers comply with the laws, especially the overtime laws.

Which is good for employment.  The purpose of the overtime laws is to force employers to hire more people.  Instead of hiring four people to work 50 hours a week, to avoid overtime an employer will hire 5 people to work 40 hours a week.

But where vigilance is still needed is in the “off the clock” work time.  If an employee works through his or her lunch hour, or is required to do a work related task, such as a bag check, before they clock in or after they clock out of work, the employee is entitled to be compensated if the time is not de minimus.
