San Diego Firm Files Class Action Complaint against California Ad Company – Los Angeles Wage & Hour Claims Attorneys Blumenthal, Nordrehaug & Bhowmik

by Norman B. Blumenthal on December 17, 2012

San Diego employment lawyers at Blumenthal, Nordrehaug & Bhowmik have filed a class action complaint against a California ad company, Local Splash, a Relevant Ads, Inc. company for wage and hour violations.  Specifically the complaint asserts that Relevant Ads, through Local Splash, violated California labor laws by requiring their employees to work off-the-clock.  The complaint also states that Local Splash employees did not receive pay for overtime hours.  Poole, et al. vs. Relevant Ads, Inc., Case No. 30-2012-00587816.

According to the class action Complaint, Relevant Ads did not pay their employees for performing such work tasks as “logging onto computers, initializing software applications, and preparing to take and/or make phone calls."  This denied Relevant Ad employees and California Class Members payment for all the hours worked as well as denied them overtime wages or overtime wages properly calculated.  The unpaid overtime Complaint also states that by failing to record all hours worked by members of the California Class, Relevant Ads allegedly failed to provide the Plaintiff and the other members of the California Class with complete and accurate wage statements which failed to show, among other things, the correct number of all hours worked and the correct overtime rate for overtime hours worked.

Founding partner of Blumenthal, Nordrehaug, & Bhowmik, Norman Blumenthal asserts, “The failure to pay employees for off-the-clock work is one of the more common violations of federal and state wage and hour laws.”

The complaint was filed August 1, 2012 and currently pending in Orange County Superior Court for the state of California.
